This study, carried out jointly by Transparência Brasil and Instituto República.org, analyzed all judicial paychecks to measure the effects of Bill 2.721/21, known as the Supersalaries Bill, on spending on judges’ salaries.
The conclusion is that the legislative proposal increases spending on salaries above the ceiling for judges and justices instead of restricting it. The text was approved by the Chamber of Deputies and is currently before the Senate.
The bill classifies 32 benefits as indemnity – therefore immune from the constitutional ceiling and, potentially, from income tax. Of these benefits, 19 are currently paid to members of the judiciary and cost R$10.5 billion in 2024 and R$6.9 billion in 2023.
- Of the R$10.5 billion spent in 2024 by the Judiciary, R$7.1 billion were paid in remuneration benefits that are improperly transformed into indemnity benefits by the Bill;
- The poor definition, in the text of the proposal, of what constitutes remuneration and indemnification leaves room for manipulations in the nature of benefits to favor the elite of the civil service;
- The bill also validates the maneuver that created one of the most expensive and damaging perks for the public administration, compensatory leave;
- Because it expands privileges and increases salaries, TB and República.org recommend that Bill 2721/21 not be approved by the Federal Senate.
Methodology
The amounts paid in each benefit were identified by analyzing an unprecedented database from DadosJusBr, a TB initiative that collects, standardizes, analyzes and publishes payslips from the justice system. The database was built by standardizing the universe of benefits received by all members of the Judiciary, which contains approximately 3,300 different nomenclatures in 60 categories.
