A year after publishing a report pointing out that public defenders fail to comply with the requirements of the Access to Information Law (LAI) regarding requests for information, Transparência Brasil repeated the analysis to identify possible advances.
There have been significant improvements in some aspects and, at the same time, important warning signs. The number of defense offices that complied with the requirements of providing a response and sending a response within a maximum of 30 days increased by 45%. On the other hand, eight defense offices are repeat offenders in not responding to requests: Alagoas, Amapá, Bahia, Espírito Santo, Goiás, Pará, Pernambuco and Roraima also failed to respond to requests last year.
- The percentage of defense offices that did not respond to the request for information decreased: from 46% in 2023 to 37% in 2024;
- Regarding the information requested in the requests for information, only three defense offices have data on the actions of their defenders in protective measures based on the Maria da Penha Law: Rondônia, Rio Grande do Sul and São Paulo;
- TB recommends the adoption of a minimum standard and list for collecting and storing data and information on the provision of justice.
